EDIT:
hmm can't seem to set any wallpaper...
appears to be two different wallpaper tools,
background - in settings, on it's own... with a fancy monitor picture.
settings - cinnamon settings - background. same sort of thing, looks different.
saw some things on the mint board no answers there.
EDIT EDIT, unrelated; if i logout to see if any changes take place i can't log in say there's been an error.no biggie as i hardly ever logout.
every reboot.

Looks like graphics driver (3d session). Can you try the 2D session and check if it works there? You see that conky paints, so as test #2 please disable conky in the startup and then try the regular login.
btw both wallpaper settings tools do the same thing, one from GNOME (pulled in by Cinnamon) and one from Cinnamon.
Edit: was is the same when booted from a stick? And now that I think about it, is it possible that this is the 2D session because it fails to load the 3D session? That would show the error you mentioned. Which gfx card do you have?
Another edit: have you changed the window decos or does it come like this? If you haven't changed it, seems there is something messed up with the default WM too. Looks like compiz, judging from the deco.

i will try the stick again, so i should really have booted from i915? if my chips are intel?

I've not installed the i915 versions either. I was having some problems with Boner when going between i915 and Default, with ceni constantly going through its process in Tmux and causing me to hard reboot.

still getting the login/out problem,
logs out fine,
try to login to default session (3d?)no joy,
this time going to 2d cinnamon in lightdm works ok but kills the background.

If it kills the conky in background, try to play with some values to adjust it in 2d mode. Hell, long time that I played with conky in desktop environments. 3d works fine here with Intel, do not ask me if it is i915. :eek:

I think this value in conkyrc made it work in 2D but not in 3D.

About the i915 thing: it's like a modeset/nomodeset specially for the Intel card. Check the #! forums, el_koraco's posts related to kernel boot parameters for Intel cards.
